Acceptable Use Policy

You agree not to store or otherwise make available on the GrowthBook Platform any of the following:

• Any Content subject to copyright that is not your original work, unless you have permission from the rightful owner to post such Content;
• Any confidential or private information of any third party;
• Any Content that is harmful, threatening, unlawful, defamatory, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, hateful, or otherwise objectionable;
• Any Content that infringes or misappropriates third-party intellectual property rights, or is invasive of privacy or publicity rights.
• Any personal data that could be legally considered sensitive in any applicable jurisdiction, including, but not limited to: (i) patient, medical, or other protected health information regulated by the Health Insurance Portability and Accountability Act (as amended and supplemented) (“HIPAA”); (ii) personal data about individuals under the age of 16, which for the avoidance of doubt includes any “personal information” as such term is defined under the Children’s Online Privacy Protection Act; (iii) government issued identification numbers, including Social Security numbers, driver’s license numbers and other state-issued identification numbers; (iv) financial account information, including financial account numbers or payment card data (including credit card or debit card numbers); (v) special categories of sensitive personal data, (such as defined under Regulation (EU) 2016/679 of the European Parliament), including personal data revealing racial or ethnic origin, political opinions, religious beliefs, trade union membership, physical or mental health or condition, sexual life, sexual orientation, genetic data, biometric data, or the commission or alleged commission any crime or offense; (vi) precise geo-location data; or (vii) any data similar to the above protected under foreign or domestic laws, including without limitation any data subject to regulation under the International Traffic in Arms Regulations (ITAR), 22 C.F.R. §§ 120-130. You represent and warrant to GrowthBook that you have all necessary rights, consents, and permissions to use and submit data that you send to the GrowthBook Properties, all without violating or infringing any applicable laws, third-party rights (including intellectual property, publicity, or privacy rights), or any terms or policies governing such data.

  
  In using the GrowthBook Services, you also agree not to do any of the following:
  

• Represent or imply that you are a representative of GrowthBook or that any of Your Content is endorsed by GrowthBook;
• Impersonate any other person or entity in your account, or falsely state or otherwise misrepresent yourself or your affiliation with any other person or entity in your account, or use an account with shared credentials;
• Intimidate or harass another user of the Service;
• Conduct any activities that could damage, disable, overburden or impair the Service, including by writing any malicious code;
• Modify another online offering or service so as to suggest that it is affiliated with the Service;
• Use GrowthBook in violation of any applicable law or regulation, including data, privacy, and export control laws in applicable jurisdictions; or
• Use GrowthBook in any situation for which they are not designed, manufactured or intended, such as for use in life support, emergency or mission critical circumstances, or in any activities where use or failure of the GrowthBook could lead to death, personal injury or property or environmental damage. For example, you may not use, or permit any other person to use, GrowthBook in connection with aircraft or other modes of human mass transportation or nuclear or chemical facilities, life support systems, implantable medical equipment, motor vehicles, or weapons systems;
  

  
  Without limiting any other remedies available to it, GrowthBook may in its sole discretion suspend or terminate access to the GrowthBook Platform or Services for violations of this Acceptable Use Policy, to prevent harm to other parties, or to preserve its security, availability or integrity.
  
  Terms not defined in this Acceptable Use Policy will have the meaning set forth in the applicable agreement between you and GrowthBook.
